(734)  LAWBURROWS: MEDIEVAL REMEDY IN THE COURTS AGAIN

On 23 January 2008 the Court of Criminal Appeal in the High Court of Justiciary rejected an appeal by way of stated case from Dumfries Sheriff Court in an action of lawburrows (Duff v Strang [2008] HCJAC 4, http://www.scotcourts.gov.uk/opinions/2008HCJAC04.html).  James Duff had raised the action against the Chief Constable of Dumfries and Galloway seeking payment of £10,000 into the court as caution against the latter troubling Mr Duff.  The pursuer’s claim was that since he had been illegally been made bankrupt” in 1976 the Dumfries and Galloway constabulary had been involved in a vendetta and conspiracy against him also involving a local sheriff
