(163)  Civil jury survives human rights challenge

The challenge to the use of the civil jury as contrary to Article 6 of the European Convention on Human Rights (fair trial: see No 143) was rejected by an Extra Division (Lords Coulsfield, Johnston and Hamilton) in Heasman v J M Taylor and Partners, 8 March 2002.
