(787)  HELLO, HELLO: MOBILE PHONE CHARGES

Ted Brocklebank, Tory list MSP for Mid-Scotland and Fife, was cleared of a charge of driving his car through Guardbridge, Fife, while using his mobile phone after Cupar District Court found there was no case to answer on 25 April 2008.  Mr Brocklebank’s solicitor argued that there was no evidence that the phone was working or capable of use for purposes of communication, and that it was not enough to show that his client had been holding the phone and looking at it.  The Crown Office is apparently considering an appeal.
