Anglicising the Lord Justice Clerk
Court reforms by the Gill Committee may already have gone further than anyone realised.
Reporter Martin Hogg draws our attention to the report of the Outer House delict case Realstone v J & E Shepherd [2008] CSOH 31 in the 2008 Professional Negligence Law Reporter ([2008] PNLR 21). The editor of the PNLR, clearly used to English judicial titles rather than Scottish ones, has rendered Lord Hodge's reference there to a judgment of Lord Justice Clerk Gill as being by "Clerk Gill L.J.".
One wonders if this is a form of professional negligence in itself, or perhaps some form of verbal injury, or an infringement of Lord Hodge's moral right of integrity. If it isn't actionable, it ought to be.
