STUDENT TUITION FEES (ENGLAND IN SCOTLAND)

Emma Block, an English student at Glasgow University, announced in January 2005 that she would be raising court proceedings to review the legality of Scottish universities’ charging fees to English, Welsh and Northern Irish students while Scottish ones are exempt.  The basis of the claim would be the Race Relations Act (which applies to discrimination between Scotland and England – see Nos 16, 20, 91), the European Convention on Human Rights, and European Community law; but it was not yet certain whether the action would be raised in a Scottish or an English court.  The Scottish Executive said that our understanding is that EU rules apply to member states and do not prevent different regulations concerning tuition fees being in force within the UK.” (Times Higher Education Supplement
