(466) OPINION IN THE McTEAR CASE: NO CIGARETTE LIABILITY
Lord Nimmo Smith’s long awaited opinion in the smoking liability case, McTear’s Exx v Imperial Tobacco (see Nos 267, 406), was published on 31 May 2005. He held that Mrs McTear’s case failed on every count. Her late husband had known of the risks of smoking when he began his habit about 1964. He had smoked roll-ups” as well as Imperial products. There was no proof of a causal link between Imperial products and the cancer which eventually claimed Mr McTear’s life
