(715)  THE MYSTERIOUS CASE OF THE VANISHING PLEA IN MITIGATION

Sheriff Robert McCreadie continued his bid for the coveted Scots Law News sheriff of the year title (No 677) earlier in December.  In a report found in both the on-line Journal of the Law Society of Scotland http://www.journalonline.co.uk/news/1004827.aspx , and in slightly more detail in its sister publication the Daily Record http://www.dailyrecord.co.uk/news/scottish-news/2007/12/13/sheriff-halts-trial-after-deleting-evidence-by-mistake-86908-20242688/ , it was reported that during a plea in mitigation on behalf of David Dutchyn, delivered by Rosie Scott at Perth Sheriff Court, Sheriff McCreadie inadvertently erased the notes he had typed on his laptop.  Sheriff McCreadie is reported to have said to Rosie Scott,
