Alan Beith, Liberal Democrat MP for Berwick, is raising concerns about the constitutionality of a draft statutory instrument, The Scotland Act 1998 (River Tweed) Order 2006, that is due to come into force at the end of October 2006.  Mr Beith says the Order will give the Scottish Parliament exclusive power to legislate about fishing rights and regulation in the Tweed basin, which includes parts of the River Tweed itself which are in England, as well as certain Tweed tributaries, such as the River Till, which are wholly in England.  Mr Beith’s variant on the West Lothian question is that here English representatives can have no say on law-making that directly affects their constituencies and constituents.  It makes good sense to have one system of management for the Tweed and its tributaries
